Significant Changes to Family Law legislation and practice from 6 May 2024

Removal of the presumption of equal shared parental responsibility

The Family Law Amendments Act 2023 (Cth)  has removed the presumption of equal share parental responsibility. In other words, parents cannot assume that the child is to spend equal time with each parent. Pursuant to section 61C of the Family Law Act 1975 (Cth) (the Act), separated parents retain parental responsibility which may be exercised jointly or separately unless this is varied by a Court order.

what is the paramount consideration of the court in determining parenting matters?

How the Court determines the best interests of the child is set out in s. 60CC of the Act. In the past, the Court has two primary considerations and other additional factors to be considered:
a. the benefit of the child having a meaningful relationship with both partes; and
b. the needs to protect the child from physical or psychological harm of being subjected or exposed to abuse, neglect or family violence.

From 6 May 2024, the law changed and there is no longer a distinction between primary and additional considerations. When determining the parenting arrangement in the best interests of the child, the court considers the factors in s 60CC(2) of the Act:

• What arrangements would promote the safety (including safety from family violence, abuse, neglect or other harm) of the child and each person who has care of the child (whether or not a person has parental responsibility for the child);
• Any views expressed by the child;
• The developmental, psychological, emotional and cultural needs of the child;
• the capacity of each person who has or is proposed to have parental responsibility for the child to provide for the child’s developmental, psychological, emotional and cultural needs;
• The benefit to the child of being able to have a relationship with the child’s parents and other people who are significant to the child, where it is safe to do so, and
• Anything else that is relevant to the particular circumstances of the child.

Additionally, new s. 66CC(2A) also requires the Court to consider family violence orders and past family violence, child abuse or neglect in determining future parenting arrangements.

Now the Court may consider equal time arrangements, or arrangements that give substantial or significant time with each parent, in accordance with the child’s best interests.

  • 申请违反法院命令;
  • 支持宣誓书;
